Terms and Conditions with Customer Information

1) Scope

1.1 These Terms and Conditions (hereinafter “T&Cs”) apply to all contracts for the supply of goods concluded between a consumer or entrepreneur (hereinafter “Customer”) and the Seller regarding the goods presented in the Seller’s online shop. Any conflicting terms of the Customer are hereby rejected unless otherwise agreed.

1.2 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their commercial or self-employed professional activity.

1.3 An entrepreneur is a natural or legal person or a legally capable partnership who acts in the exercise of their commercial or self-employed professional activity when concluding a legal transaction.

 


 

2) Conclusion of Contract

2.1 The product descriptions in the Seller’s online shop do not constitute binding offers but are intended for submission of a binding offer by the Customer.

2.2 The Customer can submit an offer via the online order form integrated into the Seller’s online shop. By placing the selected goods in the virtual shopping cart and completing the electronic ordering process, the Customer submits a legally binding offer by clicking the button to complete the order regarding the goods in the cart.

2.3 The Seller can accept the Customer’s offer within five days by:

 

  • sending a written order confirmation or confirmation in text form (fax or email), or

  • delivering the ordered goods, or

  • requesting payment from the Customer.

    The contract is concluded at the moment the first of these actions occurs. The acceptance period starts the day after the offer is sent and ends at the end of the fifth day. If the Seller does not accept within this period, the offer is considered rejected, and the Customer is no longer bound.

    2.4 When submitting an offer via the online order form, the contract text is stored by the Seller and sent to the Customer in text form (e.g., email, fax, or letter). No further provision of the contract text is made.

    2.5 Prior to submitting a binding order, the Customer can check for input errors on screen. Browser zoom functions can assist in detecting errors. Corrections can be made via usual keyboard and mouse functions until the submission button is clicked.

    2.6 The German language is available for the conclusion of the contract.

    2.7 Order processing and contact generally occur via email and automated processing. The Customer must ensure their email address is correct to receive communications from the Seller. SPAM filters should allow all emails from the Seller and third-party processors.

 

 


 

3) Right of Withdrawal

3.1 Consumers generally have a right of withdrawal.

3.2 Further details are provided in the Seller’s withdrawal policy.

 


 

4) Prices and Payment Terms

4.1 Unless stated otherwise in the product description, prices are total prices including VAT. Additional shipping costs, if applicable, are indicated separately.

4.2 Available payment methods are shown in the Seller’s online shop.

4.3 Payments via “Shopify Payments” are processed by Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland (“Stripe”). Additional terms for certain payment methods may apply. More information: https://www.shopify.com/legal/terms-payments-de

 


 

5) Delivery and Shipping Conditions

5.1 Delivery occurs within the Seller’s specified delivery area to the Customer’s provided address unless otherwise agreed.

5.2 If delivery fails due to reasons attributable to the Customer, the Customer bears reasonable costs, except when exercising the right of withdrawal.

5.3 For entrepreneurs, risk passes to the Customer once the goods are handed to the carrier. For consumers, risk generally passes upon receipt unless the Customer instructs the carrier without prior notification.

5.4 The Seller reserves the right to withdraw from the contract if delivery from suppliers fails through no fault of the Seller. Customers are promptly informed, and payments refunded.

5.5 Self-collection is not possible for logistical reasons.

 


 

6) Retention of Title

Ownership of the goods remains with the Seller until full payment is made.

 


 

7) Warranty (Liability for Defects)

7.1 For entrepreneurs:

 

  • The Seller may choose the type of rectification.

  • New goods: 1-year limitation for defect claims.

  • Used goods: no defect claims.

  • Warranty replacement does not restart limitation periods.

    7.2 The above limitations do not apply to claims for damages, fraudulently concealed defects, building-related defects, or digital product updates.

    7.3 Statutory limitation periods for legal recourse remain unaffected.

    7.4 Commercial customers have inspection and notification duties under § 377 HGB. Non-compliance means goods are deemed accepted.

    7.5 Consumers should report obvious transport damages to the carrier and notify the Seller. Failure does not affect statutory rights.

 

 


 

8) Liability

8.1 The Seller is liable without limitation for intent, gross negligence, injury to life, body, or health, warranty commitments, and mandatory liability (e.g., Product Liability Act).

8.2 For slight negligent breach of essential contractual obligations, liability is limited to foreseeable typical damage. Essential obligations are those necessary to achieve contract purpose.

8.3 Otherwise, liability is excluded.

8.4 The above applies also to the Seller’s vicarious agents and legal representatives.

 


 

9) Applicable Law

German law applies, excluding international sales law. For consumers, protection from mandatory provisions of their country of residence remains unaffected.

 


 

10) Alternative Dispute Resolution

The Seller is neither obliged nor willing to participate in dispute resolution before a consumer arbitration body.
